The following terms and conditions of agreement form part of the agreement between us, ‘the contractor’ and you, ‘the client’ wherein we will undertake all works, repairs and installations of materials as stated in the quotation.
For the purpose of these terms and conditions, “we”, “us” or “our” will refer to Turner Roofing Specialists Limited and “you” and “your” will refer to the client whose details will be specified in the quotation.
1. Turner Roofing Specialists Limited will provide written quotations free of charge to clients, unless stated otherwise. Surveys will also be free of charge, however this is subject to certain conditions. Some surveys may be chargeable if, for example, if a property is on the market for sale, pending or sold we will charge £200 + VAT.
2. Quotation is the cost of works carried out as quoted unless extra works are specified by you.
3. Estimate is the cost estimated for works or services which are subject to change if an unforeseen circumstances arise.
4. Instructions from the client detailing acceptance of a quotation is required in writing, via either email, SMS or a written letter. Instruction must be provided by the client at least 7 days prior to work commencement date. Within this 7 day period, the client has the right to cancel or postpone works if necessary.
5. The contract for between Turner Roofing Specialists Limited and the client will be valid for 30 days from quotation date. After this period, we reserve the right to re-quote due to changes in materials or labour costs.
6. Once written acceptance of the quote has been received by Turner Roofing Specialists Limited, in the circumstance where material or labour costs increase, these increases will not be passed onto the client if written acceptance is revived during the 30 days after quotation date.
7. Where possible, all works will commence on date agreed with the client and will be completed in a reasonable time scale. This is subject to any adverse weather conditions or unforeseen circumstances.
8. Turner Roofing Specialists Limited cannot be held accountable for extension of specified contract time due to additional works requested by the client, third parties, unavailability of materials, adverse weather conditions and or any unforeseen circumstances out of our control (*force majeure).
9. Any materials on site in conjunction with the contract will remain the property of Turner Roofing Specialists Limited, until payment is received in full.
10. In the unlikely event that an issue with the work carried out by Turner Roofing Specialists Limited arises, it must be brought to our attention via a written letter no later than 21 days after works are completed. Turner Roofing Specialists Limited will not be liable for any damages or issues caused after this period.
All materials or works damaged by third parties remain the responsibility of the client whilst works are still in progress. The client must pay for any damage or loss of materials or works by third parties unless they can provide valid proof of negligence by Turner Roofing Specialists Limited.
11. You agree to give us all necessary access to your property so that we can undertake the work agreed in the contract. If access is required to your neighbours or an adjacent property, it is your responsibility to obtain written permission. You must then provide a copy of this to us prior the commencement of works. You also agree we are permitted the use of all mains services including electricity and water so that we can carry out the works agreed.
12. All invoices are subject to VAT at the standard rate unless stated otherwise for certain circumstances ie; listed buildings or new builds. All invoices must be paid in full within 7 days of the invoice date. Any outstanding invoice unpaid after 21 days will be subject to an interest charge of 4% over base per month the invoice is overdue. No retentions will apply unless agreed prior to commencement of works.
13. Payments can be made either by BACS or cheque payable to Turner Roofing Specialists Limited. Please quote the invoice number as the payment reference.
14. Turner Roofing Specialists Limited carry full public and employers liability insurances, health and safety policy and risk assessments where necessary. Public liability insurance of £5,000,000.00 and employers liability insurance of £10,000,000.00.
15. Turner Roofing Specialists Limited take great pride in our work. We therefore would like the opportunity to document and take photographs of all aspects of works completed. If you object to photographs being taken of your roof, please inform us in writing. These photographs may be used for Turner Roofing Specialists Limited advertising. No details will ever be revealed as to reveal the location or identity of the building.
*Force majeure is considered to be “an act of god” or an occurrence outside the control of the parties, which impacts or delays the works. Force majeure includes issues such as unusually severe weather, labour strikes, natural disaster, or governmental actions or changes in law that negatively impact the works.
